1. Scope & variations
By accepting a quotation, the Customer agrees to this Policy. Thomo's Odd Jobs will perform only works expressly included in the accepted quotation. Anything not expressly included is excluded. Verbal discussions do not expand the scope unless confirmed in writing.
Any change to scope, specifications, materials, quantities, timing or method is a variation and may change price or timing. Variations will be documented where practicable. Mandatory requirements prevail.
2. Customer responsibilities
The Customer must provide safe access, disclose hazards and conditions, provide utilities, protect valuables, provide information, make timely decisions, obtain required approvals and pay as required. Thomo's Odd Jobs is not responsible for resulting costs or delays.
3. Existing & concealed conditions
Thomo's Odd Jobs is not responsible for defects, deterioration, damage or deficiencies existing before commencement, or latent or concealed conditions. Examples include water damage, rot, termites, mould, corrosion, movement, structural deficiencies, defective services and concealed services.
If conditions materially affect the works, Thomo's Odd Jobs may require a variation or investigation.
4. Materials & products
Materials and products are subject to manufacturer warranties. Thomo's Odd Jobs is not responsible for inherent failure of a supplied product or material not caused by workmanship or conduct for which it is legally responsible, except as required by law. Thomo's Odd Jobs may assist with applicable warranties.
Thomo's Odd Jobs may refuse Customer-supplied products appearing defective, unsafe, incompatible or unsuitable. It is not responsible for inherent failure of Customer-supplied products unless legally responsible for causing it. Lawful additional costs caused by unsuitable Customer-supplied products may be charged.
5. Workmanship & rectification
Thomo's Odd Jobs warrants that its services will be performed with the care and skill required by law. Where defective workmanship is established and Thomo's Odd Jobs is legally responsible, it must be given a reasonable opportunity to inspect and, where appropriate, rectify it.
It does not guarantee third-party products, materials, existing structures or Customer-supplied products.
6. Property damage & liability
Thomo's Odd Jobs will exercise reasonable care. Non-excludable liability remains. Thomo's Odd Jobs is not responsible for loss or damage arising from pre-existing or concealed conditions, defective existing construction, Customer-supplied products, Customer instructions or decisions, unauthorised alterations, other contractors or trades, misuse, neglect, accidental damage after completion, normal wear and tear, events beyond reasonable control or matters outside the agreed scope.
Damage for which Thomo's Odd Jobs is legally responsible will be addressed under applicable law and insurance.
7. Defects & rectification
The Customer must promptly report alleged defects and provide reasonable access to inspect and rectify. Except for necessary emergency action, the Customer should not engage another contractor to rectify disputed work before Thomo's Odd Jobs has had that opportunity.
8. Agreement & law
The quotation, scope and exclusions, variations, invoices and these Terms form the agreement, subject to law. Unenforceable provisions will be read down or severed to the minimum extent; remaining provisions continue. Queensland law applies.
Non-excludable rights under Australian Consumer Law and Queensland legislation remain. Mandatory law prevails.
