1. Quote acceptance & booking
By accepting a quotation, the Customer acknowledges and agrees to this Policy. Acceptance of a quotation accepts the quoted scope, price and applicable terms, but does not secure a booking date.
Where a deposit is required, it is immediately due unless the quotation states otherwise. The booking is secured only when the deposit is received in cleared funds. Until then, the proposed date is provisional and may be offered to another customer.
2. Deposit delay
Failure or delay in paying a deposit may result in the commencement date being delayed, released, rescheduled or the booking cancelled. If the deposit is later paid, the original date is not guaranteed and the booking is subject to availability.
Thomo's Odd Jobs is not responsible for loss of availability caused by delayed deposit payment. Any statutory deposit limit applies.
3. Customer cancellation
If a secured booking is cancelled by the Customer within 24 hours before the written commencement date and time, a $150.00 cancellation fee is payable, subject to law. The fee reflects reasonable commercial loss and administration arising from late cancellation of reserved labour and booking capacity, including scheduling and loss of alternative work.
The fee is a cancellation charge only. It is not payment for labour, materials or services and does not create any entitlement to labour, materials, credit or a replacement booking.
The fee does not apply where Thomo's Odd Jobs cancels, where cancellation follows Thomo's Odd Jobs' material breach, where the Customer exercises a non-excludable statutory right, or where law prohibits the fee.
4. Material scope change
If, after acceptance, the Customer discloses, requests or introduces a material change to scope, specifications, materials, site conditions or requirements not reasonably disclosed before acceptance, Thomo's Odd Jobs may, acting reasonably, determine that the original booking cannot proceed on its original basis and may cancel or decline the original booking.
If cancellation occurs within 24 hours before commencement, the $150.00 fee may apply, subject to law. Any revised scope, price or date should be agreed in writing before additional work begins.
5. Rescheduling
Thomo's Odd Jobs may reschedule subject to availability and may, at its discretion, waive the cancellation fee. A waiver is discretionary and is not a precedent. A later qualifying cancellation may attract the fee again.
6. Invoices & late payment
Invoices are due on the stated due date. Cleared funds must be received by that date. An overdue invoice may incur a $5.00 late-payment administration fee for each business day overdue, starting the next business day and ending when cleared funds are received.
The fee does not compound and will not exceed reasonable administration costs incurred for the overdue account. A genuine dispute must be notified in writing promptly, stating the disputed amount and basis. Undisputed amounts remain payable.
7. Non-payment & recovery
For overdue amounts, Thomo's Odd Jobs may suspend or postpone work where lawful. Reasonable, legally recoverable suspension, remobilisation and rescheduling costs may be charged.
Thomo's Odd Jobs may pursue overdue debts and recover reasonable recovery costs actually incurred where lawful. Nothing in this Policy excludes or limits any right, guarantee, warranty or remedy that cannot legally be excluded or limited.
